Terms & Conditions

1. About These Terms

These Terms & Conditions apply to your use of the Haunts website and to purchases made through our online shop.

Please read them carefully before placing an order.

By placing an order through our website, you agree to these Terms & Conditions. Our Privacy Policy, Cookie Policy and Delivery & Returns Policy also contain important information about your use of the website and purchases from Haunts.

Nothing in these Terms affects your statutory rights as a consumer.

2. About Haunts

Haunts is a trading name operated by:

Haunts

98 Huddersfield Road
Holmfirth
West Yorkshire
HD9 3AX
United Kingdom

Email: info@hauntme.co.uk

Website: hauntme.co.uk

When you purchase a product from Haunts, your contract is with Haunts.

3. Who Can Place an Order

You must be at least 18 years old and legally capable of entering into a contract to place an order through our website.

Our online shop currently accepts orders for delivery to England, Scotland and Wales only. We do not currently deliver to Northern Ireland or destinations outside Great Britain.

4. Our Products

Haunts are handmade and hand-finished decorative ornaments.

Because of the handmade nature of our products, there may be small variations between individual Haunts, including differences in colour, texture, finish and detail.

These natural variations are part of the character of a handmade product and do not necessarily mean that an item is faulty.

We make reasonable efforts to display our products accurately on the website. However, photographs are illustrative and colours may appear slightly different depending on lighting, photography, screen settings and the device you use.

The product you receive should nevertheless correspond with the product and description you ordered, subject to reasonable handmade variation.

Nothing in this section affects your statutory rights where goods are faulty, damaged, not as described or otherwise do not conform to the contract.

The intentions, rituals and spiritual associations accompanying Haunts are symbolic and intended for personal reflection and enjoyment. They do not constitute a guarantee of any particular outcome.

5. Decorative Use and Product Care

Haunts are indoor decorative ornaments and are not children’s toys.

They should be used and cared for in accordance with any care information supplied with the product or made available on our website.

Please handle your Haunt with appropriate care. Handmade decorative items may be damaged if dropped, knocked, exposed to unsuitable conditions or otherwise handled inappropriately.

Where relevant, small decorative components, packaging or accompanying materials should be kept away from young children where they could present a hazard.

Nothing in this section excludes our responsibility to supply products that meet the requirements of applicable consumer law.

Haunts are indoor decorative ornaments and are not toys. Keep away from naked flames, direct heat and young children. Handle with care, as ornaments may chip or break if dropped. Some products have a light wax finish which may transfer to delicate or porous surfaces.

6. Product Availability

All products are subject to availability.

Adding an item to your basket does not reserve it.

If, after you place an order, we discover that a product is unavailable or that we cannot fulfil your order, we will contact you as soon as reasonably possible.

Where we cannot supply an item you have paid for, we will refund the amount paid for that item and any applicable delivery amount that must be refunded.

7. Prices

Prices displayed on our website are shown in pounds sterling (GBP).

The price payable for a product will be the price displayed as part of the checkout process when you place your order, subject to the provisions below concerning errors.

Delivery charges are shown separately where applicable and will be displayed before you place your order.

We may change product prices at any time, but changes will not normally affect orders for which a contract has already been formed.

8. Pricing and Website Errors

We take reasonable care to ensure that product descriptions, prices and other information on our website are accurate.

Occasionally, an obvious pricing, description or technical error may occur.

If we discover an error affecting your order before a contract has been formed, we may contact you to explain the error and give you the opportunity to proceed on the correct basis or cancel the order.

If a contract has already been formed, we will deal with any error fairly and in accordance with applicable consumer law. Nothing in these Terms allows us to charge you a higher price than you agreed without your agreement.

9. Placing an Order

To place an order, follow the checkout process on our website and provide the information requested.

Before submitting your order, you will have an opportunity to review your basket and relevant order information.

Please check your information carefully before placing your order, particularly:

  • Products and quantities
  • Billing information
  • Delivery name and address
  • Delivery method
  • Gift recipient details, where applicable
  • Total price

You are responsible for ensuring that the information you provide is complete and accurate.

Placing an order means you are making an offer to purchase the products in your order.

10. Order Acceptance and Formation of the Contract

After you place an order, you should receive an email acknowledging that we have received it.

An acknowledgement of your order does not necessarily mean that we have accepted it.

Your order constitutes an offer to purchase. A contract is formed when we send you an email expressly confirming that your order has been accepted. An automated acknowledgement of receipt does not constitute acceptance.

If we cannot accept your order, we will let you know and will refund any payment taken for products we cannot supply.

Reasons we may be unable to accept an order can include product unavailability, inability to authorise payment, an error in the price or description, suspected fraudulent or unlawful activity, or inability to deliver to the address provided.

We will not refuse or cancel an order for an unlawful or discriminatory reason.

11. Payment

You must pay for your order using one of the payment methods made available at checkout.

Payments are processed through WooPayments and its payment-processing infrastructure.

Payment must be successfully authorised before an order can be fulfilled.

We do not require you to provide full payment-card information directly to us outside the secure payment process provided at checkout.

Your payment provider may carry out additional security or verification checks.

12. Order Confirmation

We will provide confirmation of your order electronically, normally by email.

Please provide a valid email address and check the order confirmation carefully. If you notice an error in your order information, contact us as soon as possible at info@hauntme.co.uk.

Please retain your order confirmation and these Terms for your records.

13. Delivery

We currently deliver to England, Scotland and Wales.

As our products are handmade and carefully prepared for dispatch, please allow up to 2–3 working days for order processing before dispatch, unless otherwise stated on the product page.

Standard Delivery

Standard Delivery costs £3.65 per order.

We aim for Standard Delivery orders to arrive within 2–3 working days after dispatch.

Faster Delivery

Faster Delivery costs £4.65 per order.

We aim for delivery on the next working day following dispatch, although this is an estimated service and not guaranteed.

The estimated delivery period begins after dispatch. Time required to prepare and pack an order is separate from the delivery estimate.

We will deliver within any period specifically agreed with you or otherwise within the period required by applicable consumer law.

Further information is available in our Delivery & Returns Policy.

14. Delivery Information

You are responsible for providing a complete and accurate delivery address.

Please check delivery information carefully before submitting your order.

If you realise that you have provided incorrect delivery information, contact us at info@hauntme.co.uk as soon as possible. We cannot guarantee that an address can be changed once an order has been prepared or dispatched.

If an order cannot be delivered because incorrect or incomplete information was supplied, we will contact you where reasonably possible to arrange the appropriate next step. Additional reasonable delivery costs may be payable where redelivery is required because of information supplied incorrectly by the customer, where permitted by law.

15. Responsibility for Goods During Delivery

Goods remain at our risk until they come into the physical possession of you or a person you have identified to receive them on your behalf.

If you arrange for delivery using a carrier that was not offered by us as a delivery option, responsibility may pass differently in accordance with applicable law.

16. Gift Orders

You may choose to have an order delivered to another person as a gift where this functionality is available.

You are responsible for ensuring that the recipient’s name, delivery address and any gift information you provide are accurate.

Where you provide a gift message, you must not include content that is unlawful, threatening, abusive, discriminatory, defamatory, obscene or otherwise inappropriate.

We may decline to reproduce a gift message containing such material.

Information about how we use gift recipient details and gift messages is provided in our Privacy Policy.

17. Your Right to Change Your Mind

If you are purchasing as a consumer online, you will normally have a legal right to change your mind and cancel your purchase.

For eligible goods, you may tell us that you wish to cancel within 14 days after receiving the goods.

You then have a further 14 days from the date you tell us you are cancelling to return the goods.

You do not need to provide a reason for exercising this cancellation right.

To cancel, contact us at: info@hauntme.co.uk

Full instructions, including the model cancellation form, are provided in our Delivery & Returns Policy.

18. Change-of-Mind Returns

If you cancel an eligible purchase within the cancellation period, you are responsible for the direct cost of returning the goods unless we have agreed otherwise or applicable law requires us to pay that cost.

Please package returned items securely and retain proof of postage.

We may wait until we receive the returned goods, or until you provide evidence that you have sent them back, before issuing the refund where permitted by law.

You may inspect your Haunt as you reasonably would if examining an item in person.

If you handle the product beyond what is necessary to establish its nature, characteristics and condition and this reduces its value, we may make an appropriate deduction from the refund where permitted by law.

Contacting us before returning an item helps us provide the correct return address and instructions, but this requirement does not remove or restrict your statutory cancellation rights.

19. Refunds Following Cancellation

Where you validly cancel an eligible order, we will refund the price paid for the returned goods and the cost of our standard delivery option where required by law.

If you chose a more expensive delivery method, we are not required to refund the additional amount above the cost of our standard delivery service.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

We will make the refund within the timescale required by applicable consumer law.

Further information is provided in our Delivery & Returns Policy.

For eligible goods, the cancellation period ends 14 days after the day on which you, or a person nominated by you, receive the goods. Following cancellation, you must return the goods within a further 14 days. Where permitted by law, we may withhold the refund until we receive the goods or evidence that they have been returned, whichever is earlier. Refunds will be issued within 14 days of that date.

20. Faulty, Damaged, Incorrect or Misdescribed Goods

We are under a legal duty to supply goods that conform to the contract.

Among other requirements, goods supplied to consumers must be of satisfactory quality, fit for any particular purpose required by law and as described.

If your Haunt is faulty, arrives damaged, is not as described or you receive the wrong item, please contact:

info@hauntme.co.uk

Please include your order number and information about the problem. Photographs are helpful where possible because they can allow us to understand and resolve the issue more quickly.

However, providing photographs, contacting us before returning an item or retaining original packaging are not conditions of your statutory rights.

Where a return is required because goods are faulty, damaged, incorrect or not as described, we will cover reasonable return postage costs where required.

Nothing in these Terms or our Delivery & Returns Policy affects your statutory rights.

Under the Consumer Rights Act 2015, consumers generally have a short-term right to reject faulty goods within 30 days, subject to the provisions of the Act. Further rights to repair, replacement, price reduction or a refund may apply thereafter.

21. Customer Accounts

You may have the option to create a customer account.

You are responsible for providing accurate account information and for taking reasonable steps to keep your login details secure.

You must not allow another person to use your account in a way that is unlawful or breaches these Terms.

If you believe that somebody has accessed your account without permission, please contact us.

We may suspend or restrict an account where reasonably necessary to protect the website, customers or Haunts from fraud, security threats or misuse.

22. Marketing Communications

Placing an order does not require you to consent to marketing emails.

Subscription to the Haunts Coven mailing list is optional and is not a condition of purchase. Marketing communications will only be sent where permitted by applicable data protection and electronic marketing laws. You may unsubscribe at any time using the link provided in our marketing emails.

Further information is provided in our Privacy Policy.

23. Our Responsibility to You

We do not exclude or limit liability where it would be unlawful to do so.

Nothing in these Terms excludes or restricts liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Breach of your statutory rights relating to goods
  • Any other liability that cannot lawfully be excluded or restricted

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of contract or our failure to use reasonable care and skill.

Loss or damage is foreseeable if it is obvious that it will happen or if, when the contract was made, both you and we knew that it might happen.

We are not responsible for loss or damage that is not foreseeable, except where the law provides otherwise.

Our products are supplied for private and domestic use. If you use products for commercial, business or resale purposes, different legal considerations may apply.

Nothing in this section affects rights or remedies that cannot legally be excluded or limited.

24. Events Outside Our Reasonable Control

Sometimes we may be prevented or delayed from carrying out our obligations by circumstances outside our reasonable control.

Examples may include significant postal or courier disruption, severe weather, failure of essential infrastructure, widespread internet or telecommunications disruption, fire, flood or other events that could not reasonably have been prevented.

Where this happens, we will take reasonable steps to minimise the effect of the disruption and will contact affected customers where appropriate.

This section does not remove any statutory rights you may have, including rights relating to delivery.

25. Website Use

You may use our website for lawful personal purposes, including browsing our products, managing your account and purchasing goods.

You must not use the website:

  • In breach of applicable law
  • Fraudulently or for an unlawful purpose
  • To attempt to gain unauthorised access to the website, accounts, servers or systems
  • To introduce viruses, malware or other harmful material
  • To interfere with the operation, security or availability of the website
  • To collect information about other users without lawful authority
  • To misuse checkout, payment, account or other website functionality

We may take reasonable measures to prevent or respond to misuse, fraud, security threats or unlawful activity.

26. Automated Access and Scraping

You must not use automated systems, bots, scraping tools or similar technologies to access, extract, reproduce or interfere with website content in a manner that breaches applicable law, infringes our rights, places an unreasonable burden on the website or circumvents technical protections.

Nothing in this section restricts activity that we have expressly authorised, or that cannot lawfully be restricted.

27. Intellectual Property

Unless stated otherwise, the content of the Haunts website, including its branding, product names, original text, photographs, illustrations, graphics, designs, symbols, artwork and website content, is owned by or licensed to Haunts and is protected by applicable intellectual-property laws.

You may view the website and make reasonable personal use of its content.

You must not reproduce, distribute, commercially exploit, modify or use our protected content without permission except where permitted by law.

Purchasing a Haunt does not transfer intellectual-property rights in the product design, branding, accompanying artwork, ritual content or other protected material.

28. Website Availability

We aim to keep the website available and functioning correctly, but we cannot guarantee uninterrupted or error-free access at all times.

We may temporarily suspend, restrict or modify parts of the website where reasonably necessary for maintenance, security, updates or circumstances outside our reasonable control.

We will not use this provision to avoid obligations relating to orders or consumer rights.

29. Website Information

We take reasonable care to keep information on our website accurate and up to date.

However, general website content may occasionally contain errors or become outdated.

Product descriptions, prices and other information forming part of a consumer purchase are subject to the protections provided by applicable consumer law and the other provisions of these Terms.

30. Third-Party Links

Our website may contain links to websites or services operated by third parties.

We are not responsible for the content, availability, security or privacy practices of third-party websites that we do not control.

A link does not necessarily mean that we endorse the third party or its content.

31. Privacy and Cookies

We process personal information in accordance with our Privacy Policy.

Our use of cookies and similar technologies is explained in our Cookie Policy.

These policies should be read alongside these Terms where relevant.

32. Changes to These Terms

We may update these Terms & Conditions from time to time, for example to reflect changes to our business, website, products, services or applicable law.

The Terms that apply to a purchase will normally be those in effect when you place your order.

We will not retrospectively change the terms of an existing contract in a way that unfairly disadvantages you.

The latest version will be published on our website with an updated revision date.

33. If Part of These Terms Is Invalid

If any provision of these Terms is found by a court or other competent authority to be unlawful or unenforceable, the remaining provisions will continue to apply.

Where appropriate, the affected provision will apply to the maximum extent permitted by law.

34. Our Failure to Enforce These Terms

If we do not immediately enforce a right or provision under these Terms, this does not necessarily mean that we have waived that right.

35. Transfer of Rights

We may transfer our rights or obligations under these Terms to another person or organisation where permitted by law and where doing so does not reduce your rights under the contract.

You may transfer your rights under a contract where the law permits or where we agree.

36. No Rights for Third Parties

Except where applicable law provides otherwise, these Terms are between you and Haunts.

No other person has a right to enforce these Terms solely by virtue of the Contracts (Rights of Third Parties) Act 1999.

37. Governing Law and Disputes

The laws of England and Wales govern these Terms. If you are a consumer resident in Scotland, you will continue to benefit from any mandatory consumer protections applicable to you, including any rights relating to where legal proceedings may be brought.

If you live in England or Wales, you can bring legal proceedings in the courts of England and Wales.

If you live in Scotland, you may bring legal proceedings in the Scottish courts where applicable.

Nothing in these Terms deprives you of mandatory consumer protections or rights regarding where legal proceedings may be brought.

If you have a problem with an order, we encourage you to contact us first at info@hauntme.co.uk so that we can try to resolve the matter.
